§ 1 Operator of the online shop and validity of these general terms and conditions
1. This online shop is operated by Aleri GmbH, Künische Str. 2, 93059 Regensburg. Aleri GmbH is registered with the registry court of the Regensburg District Court (HRB 13566). Managing directors: Loredana Ciucanu, Gavril Ciucanu.

2. These terms and conditions apply exclusively to the sale of goods by us. Other terms and conditions, in particular customer terms and conditions, only apply if they have been accepted by us.

3. We sell our goods exclusively to consumers and only in commercially available quantities.

4. German is the exclusive contract language.

5. The sale takes place within Germany and the EU, the billing and delivery address must therefore be in Germany or the EU.

§ 2 Conclusion of contract
1. You can select individual goods from the range in the online shop and collect them in an electronic shopping cart by clicking on the "Add to shopping cart" button. An order that is binding for you is only concluded when you have entered all the data required to execute the contract, confirmed that you have read these terms and conditions and clicked the "Buy" button. You can change and correct your order and the data you provided for your order at any time until you click this button.

2. After placing your order, you will receive an automatically generated confirmation of receipt of your order by email. This confirmation of receipt will list your order details and these General Terms and Conditions again. If you have not already printed out and/or otherwise saved your order details and these General Terms and Conditions during the ordering process, we recommend that you print out and save this email. We do not save any data. The confirmation of receipt does not constitute a purchase contract; the confirmation of receipt merely documents that we have received your order.

3. We reserve the right to accept your order; we are not obliged to conclude a contract based on your order. We only accept your order when we dispatch the ordered goods. You will receive notification of this by a separate email. We do not accept orders from minors under the age of 18.

4. The minimum delivery value is €1.00, which means that we are unfortunately unable to deliver goods below this value.

5. By placing your order, you agree to receive our invoice in electronic form. The invoice in the form of a PDF document will be sent to you as an attachment in a separate email to your order.

§ 3 Availability and delivery time of goods
1. If one or more of the goods you ordered are no longer available at the time of your order, we will unfortunately not be able to fulfill your order in full. In such a case, we reserve the right to partially fulfill the order or to reject it in full. We will then inform you of this immediately by email.

2. If the goods you have ordered are available, the delivery time to the address you have specified is approximately 3 to 4 working days after receipt of your order. With the DHL Express shipping option, your order will be delivered on the next working day (delivery only Monday to Friday), provided you have placed your order in our online shop by 1:00 p.m. All orders received after 1:00 p.m. will be processed on the next working day (delivery
Delivered Monday to Friday only) until 12:00 noon.

Delivery times for the shipping option "DPD Express":

Ordered Monday - Thursday before 11:00 a.m. => delivered the next working day (Tuesday - Friday) by 6:00 p.m.
Ordered after 11:00 a.m. on Thursday and before 11:00 a.m. on Friday => delivered by 6:00 p.m. the following Monday.
Ordered Friday after 1:00 p.m. until Sunday => delivered the following Tuesday by 6:00 p.m.
If you choose to pay in advance, your order will only be processed after receipt of payment.

3. Delivery is only possible within Germany and by DHL and DPD.

§ 4 Price
1. All prices stated for goods in the online shop include the applicable statutory sales tax.

2. We also charge €4.99 for shipping costs for each shipment. Standard shipping with DHL or DPD is free for orders over €50. For orders delivered via DPD Express shipping, shipping costs are an additional €7.50.


§ 5 Terms of payment
1. You can choose between different payment methods:

Payment by credit card (Visa, MasterCard, American Express)

Payment in advance: if you select the payment method "Prepayment", you will receive a separate email with information about our bank details after completing your order.

Payment via PayPal: Your bank or credit card details are stored with PayPal after you have registered.

2. Please note that due to agreements you have made with credit institutions or other institutions, you may incur additional costs for transfers, account management, etc.

3. We reserve the right to restrict the use of the above-mentioned payment methods individually to the use of one or more payment methods.

4. Section 286 paragraph 3 of the German Civil Code applies; according to this, you are in default 30 days after the purchase price is due. We reserve the right to assert further claims, including but not limited to claims for damages and claims for default interest.

§ 6 Retention of title
The delivered goods remain our property until full payment has been made.

§ 7 Claims for defects and liability for damages
1. The statutory provisions on material and legal defects apply. All information on the goods are descriptions of their quality and do not constitute a guarantee.

2. We are liable for damages for intentional and grossly negligent conduct on the part of our bodies and vicarious agents, and regardless of the degree of fault, for damages resulting from injury to life, body or health. We are also liable for slight negligence on the part of our bodies and vicarious agents in the event of impossibility, delay in performance, non-compliance with a guarantee or breach of any other material contractual obligation; material contractual obligations are those on whose compliance you can regularly rely or which make the implementation of the contract possible in the first place. In the event of slightly negligent breach of the aforementioned obligations, our liability is limited to such damages typical of the contract that we could reasonably have expected when concluding the contract. Any liability for damages on our part that goes beyond the liability according to the aforementioned rules is excluded. The aforementioned limitations of liability also apply to the benefit of our bodies and vicarious agents.

3. Claims under the Product Liability Act remain unaffected.

§ 8 Copyright and trademarks
The website operated by us and its entire content, in particular texts, photos, images, graphics, prints, textile designs, films, presentations, sounds, illustrations and any software as well as all trademarks and/or designs are all protected against unauthorized use by industrial property rights, in particular copyrights, name and image rights, trademarks and/or registered or unregistered design rights. Any use other than selecting and purchasing a product requires the prior written consent of us or, if we do not hold the respective rights, of the rights holder.

§ 9 Applicable law
The substantive law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

§ 10 Reference to telephone costs
You will incur telephone charges for telephone contact in accordance with your telephone contract; there are no further costs beyond this.

§ 11 Reference to Battery Act
Since we sell batteries and rechargeable batteries or devices that contain batteries and rechargeable batteries, we are obliged under the Battery Act (BattG) to inform you of the following: Batteries and rechargeable batteries must not be disposed of in household waste; you are legally obliged to return used batteries and rechargeable batteries. Old batteries can contain harmful substances that can harm the environment or your health if not stored or disposed of properly. Batteries also contain important raw materials such as iron, zinc, manganese or nickel and are recycled. You can return the batteries after use in your area (in shops or at municipal collection points). The crossed-out garbage can means that you must not dispose of batteries and rechargeable batteries in household waste.

§ 12 Right of withdrawal and cancellation policy

Cancellation policy

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.

To exercise your right of withdrawal, you must inform us (Aleri GmbH, Künische Str. 2, 93059 Regensburg and email address info@aleridesign.com) by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If you cancel this contract, we will refund all payments that we have received from you, excluding delivery costs (with the exception of additional costs resulting from your choosing a different type of delivery than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us that you have cancelled this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.

We charge a restocking fee of 5% EUR for returns. The return fee will be deducted from the refund. You will bear the cost of returning the goods.

You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

2. If you return the delivered goods to us within the cancellation period without an expressly declared cancellation, we will treat this as a cancellation and the cancellation consequences explained above will apply.

§ 13 Extended contractual right of return and fair use policy
1. Regardless of your legal right of cancellation, we offer you an extended right of return. You can return your order to us in whole or in part within 14 days without giving any reason.
For each return we will charge you a restocking fee of 5% per package.

2. Fair Use Policy
A basic requirement for being able to offer a good price/performance ratio is our lean cost structure. The return rate
an important role, because an excessive number of returns not only means an increased environmental impact but also high costs for us. To compensate for this, we would have to increase our sales prices, which would not be fair to customers who have a normal return rate. With this in mind, our system recognizes when the generous return policy is being exploited. We therefore reserve the right to exclude customers who return goods extraordinarily often from shopping. The fair use policy helps us to make your online shopping experience the best possible and at fair prices. That is why we try to limit behavior that exploits our service at the expense of other customers, our company and the environment.

§ 14 Consumer arbitration
Aleri GmbH is fundamentally neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
